The purpose of this work is to provide a different outlook on current eonomic crisis. In particular, an attempt has been made to establish whether the Italian legal system provides contractual instruments which may allow enterpreneurs to use them to manage business risk and to mitigate the adverse effects of the on-going economic crisis. In particular there has been an attempt to re-evaluate the function of some legal arrangements adapting it to the new social and economical requirements.
