The Consulta declares the illegitimacy of the expressive norms of the automatic attribution of the patronymic in order to preserve the principle of equality of the parents and the personal identity of the children, although the faculty of attributing to the latter the surname of a single parental branch seems to contradict the philosophy that animates the decision, ending up stigmatizing the search for the best interests of the child.

La Consulta dichiara l’illegittimità delle norme espressive dell’automatica attribuzione del patronimico al fine di preservare il principio di uguaglianza dei genitori e l’identità personale dei figli, quantunque la facoltà di attribuire a questi ultimi il cognome di un solo ramo genitoriale sembra contraddire la filosofia che anima la decisione, finendo per stigmatizzare la ricerca del miglior interesse del minore.
