Muslim minors in diaspora countries represented weak sections of civil society and deserve special attention and care in consideration of the implications related to their confessional status. Union countries regulate some rites of Islam in different ways, such as circumcision, and this terrain often represents the occasion for discrimination and unequal treatment. According to the Italian experience, the main problems arise from the absence of an agreement on a constitutional basis with the representatives of the Islamic communities and circumcision becomes a right or a crime depending on the subjects who intend to practice it. These different approaches are not always in line with the aim of promoting social inclusion and civil coexistence.
I minori musulmani che si trovano nei Paesi della diaspora rappresentano fasce deboli della società civile e meritano un’attenzione specifica in considerazione delle implicazioni legate al loro status confessionale. Difatti, alcuni riti dell’islam come la circoncisione, non sempre vengono disciplinati nei diversi Stati dell’Unione con normative convergenti, e spesso rappresentano l’occasione per discriminazioni e disparità di trattamento. Secondo l’esperienza italiana, in particolare, i problemi principali derivano dall’assenza di un’intesa su base costituzionale con i rappresentanti delle comunità islamiche e la circoncisione diventa può diventare un diritto o un reato a seconda dei soggetti che intendono attuarla. Questi approcci diversi non risultano sempre in linea con l’obiettivo di favorire l’inclusione sociale e la convivenza civile.
