In a cyclical manner, in reporting some news stories, the media associate criminally relevant facts with the cultural-religious belonging of their authors, polarizing attention on Islam and reviving the debate around the plural structure of our Western societies. Although in Italy the relationship between the religious factor and penal law certainly shows a concrete and tangible interest, despite the lack of a dedicated constitutional model and a current and specific law on religious freedom, the resulting doctrinal discussions do not always place the difference between behaviors guided by cultural heritage and vice versa imposed by religious beliefs. Therefore, having suitably separated the spheres and encountering a certain gradient of religious illiteracy, internal and external to the confessional communities, a hermeneutic paradigm exercised by suitable subjects is hoped for, in order to provide the appropriate hermeneutical coordinates on both levels, legal and confessional, to properly live their religion as residents of the diaspora and European citizens.
In maniera ciclica, nel riportare alcune notizie di cronaca, i media accomunano fatti penalmente rilevanti alla appartenenza culturale-religiosa dei loro autori, polarizzando l’attenzione sull’Islam e rivivificando il dibattito attorno all’assetto plurale delle nostre società occidentali. Sebbene in Italia il rapporto tra fattore religioso e diritto penale mostra certamente una concreta e tangibile interessenza, pur nella mancanza di un modello costituzionale dedicato e di una legge attuale e specifica sulla libertà religiosa, non sempre nelle conseguenti discussioni dottrinali viene messa nella opportuna luce la differenza esistente tra comportamenti guidati da retaggi culturali e quelli viceversa imposti da credenze religiose. Dunque, separati opportunamente gli ambiti e riscontrando un certo gradiente di analfabetismo religioso, interno ed esterno alle comunità confessionali, viene auspicato un paradigma ermeneutico esercitato da soggetti idonei, al fine di fornire le opportune coordinate ermeneutiche su entrambi i piani, legale e confessionale, per vivere correttamente la propria religione da residenti nella diaspora e cittadini europei.
