The paper seeks to reflect on the impact of the Sport Reform in our legal system. The sports sector has long been neglected by the Italian legislator, creating a gap that has fuelled strong discrimination between the parties that, in various capacities, operate in the sports sector. Key principles of the Reform are: equality of treatment, non-discrimination; and gender equality in sports activities. From the contribution emerges the legislator's intention to overcome unequal treatment and discrimination providing an unambiguous definition of a sports worker, trying to overcome the dichotomy between professionals and amateurs. The contribution also examines the new regulations on membership and sporting ties, provided for by Legislative Decree No. 36 of 28 February 2021. The paper takes into consideration the definition of a sports worker, examining the elements that characterise it and dwelling on certain problematic issues such as the value of the sports job description, approved by ministerial decree, without neglecting the repercussions application in the world of football.
Il saggio si propone di riflettere sull’impatto della Riforma dello Sport nel nostro ordinamento. Il settore sportivo è stato a lungo trascurato dal Legislatore italiano creando un vuoto normativo che ha alimentato forti discriminazioni tra i soggetti che, a vario titolo, operano nell’ordinamento sportivo settoriale. Principi cardine della Riforma sono: "parità di trattamento", "non discriminazione" e "parità di genere" nel lavoro sportivo. Dal contributo emerge l’intento del Legislatore di superare le disparità di trattamento e le discriminazioni fornendo un’univoca definizione di lavoratore sportivo, provando a superare la dicotomia tra professionisti e dilettanti. Il contributo esamina, altresì, la nuova disciplina del tesseramento e del vincolo sportivo, prevista dal d. lgs. 28 febbraio 2021, n. 36. Lo scritto prende in considerazione la definizione di lavoratore sportivo, esaminando gli elementi che la caratterizzano e soffermandosi su alcune questioni problematiche quali il valore del mansionario sportivo, approvato con decreto ministeriale, senza trascurare le ricadute applicative nel mondo del calcio.
