This unpublished essay was to be one of the introductory relations at the conference “La istituzione giudiziaria nel XXV anniversario dell’entrata in funzione del Consiglio Superiore della Magistratura. Esperienze e prospettive”, held at the University of Parma in June 1984. Scarpelli, who had been a judge before becoming an university professor, did not present his paper, we do not know why. The study is concerned with the reasons which must govern a judge decision in a rule of law situation. The author produces an admirable synthesis of the main models of an ideal judge which have influenced modern legal and political thinking and history, in an attempt both to recall the background and to sketch the perspectives of modern legal culture. It is also an attempt to to restore a much needed historical memory.
