The Supreme Court of Cassation, following the ruling of the Palermo Court of Appeal, clarified with the aforementioned ruling that the former spouse is entitled to a survivor's pension if they were previously entitled to alimony, have not remarried, and the deceased's employment preceded the divorce. Furthermore, the survivor's pension is eventually divided between the former spouse and the surviving spouse, taking into account factors such as the length of the marriage, financial circumstances, any premarital cohabitation, and the solidarity nature of the alimony itself.
La Cassazione, a seguito del pronunciamento della Corte di Appello di Palermo, ha avuto modo di precisare, con il pronunciamento in parola, come l’ex coniuge abbia diritto alla pensione di reversibilità, laddove sia già precedentemente titolare di assegno divorzile, non abbia contratto nuove nozze e il rapporto di lavoro del defunto fosse antecedente al divorzio. La pensione di reversibilità, inoltre, viene eventualmente ripartita tra l’ex coniuge ed il coniuge superstite considerando aspetti come la durata del matrimonio, le condizioni economiche, l’eventuale convivenza prematrimoniale e la funzione solidaristica dell’assegno stesso.
