This work is inspired by the last ruling on the merits of case-law, about the relationship between the arbitration clauses, contained in the individual agreements concluded between the soccer player and his club and its bankruptcy. After analysing the legal framework concerning the employment relationship between the soccer player and his company, that leads to widen the definition of breach of sportemployment contract, we should wonder wheter there are limits to the application of previous clauses, in particular if the bankruptcy of the society and its revocation from the federation shall be considered obstructive. In order to adequately answer such question, it is not sufficient to simply stick to mere normative data, but it seems dutiful to consider the solutions offered by recent prevailing jurisprudence. Therefore, the aim of reflection is to illustrate the way in which the decision is placed over prevailing reviews of jurisprudence, notably in light of the last position taken by the United Sections, without neglecting the opinions of the most authoritative doctrine on the subject. The judgement reaches a positive conclusion in order to the applicability of such clauses concluded by the bankrupt against the trustee intervening in the contract, taking, as well, a view that most arguments lead undoubtedly to share.
Il presente lavoro trae spunto dall’ultima pronuncia della giurisprudenza di merito in relazione al rapporto fra le clausole compromissorie inserite all’interno dei contratti individuali stipulati fra il calciatore e la società ed il fallimento della medesima.Terminata la disamina della disciplina normativa del rapporto di lavoro che lega il calciatore professionista alla società e che induce ad ampliare la definizione di inadempimento del contratto di lavoro sportivo, è opportuno interrogarsi circa l’esistenza di limiti all’applicabilità delle predette clausole, in particolare se il fallimento della società e la conseguente revoca dell’affiliazione alla federazione siano a tal uopo da considerarsi ostativi. Per dare un’adeguata risposta al quesito non è sufficiente attenersi al mero dato normativo, ma ne pare doverosa l’integrazione alla luce delle soluzioni recentemente offerte dalla giurisprudenza prevalente. Scopo della riflessione è, dunque, illustrare il modo in cui la decisione si colloca rispetto al panorama giurisprudenziale prevalente, in particolare sulla scorta dell’ultima posizione assunta dalle Sezioni Unite, senza tuttavia tacere le opinioni della più autorevole dottrina in materia. La sentenza giunge ad una conclusione favorevole all’opponibilità della clausole stipulate dal fallito nei confronti del curatore subentrato, assumendo, così, una posizione che le maggiori argomentazioni portano senz’altro a condividere.
